JK Govt Terminates Services of 103 Fireman Appointees Found Illegally Selected
The Government of Jammu & Kashmir, Home Department, has ordered the termination of services of 103 Fireman / Fireman Driver appointees in the Fire & Emergency Services (F&ES) Department.
The action has been taken after detailed findings by an Inquiry Committee and the Anti-Corruption Bureau (ACB), J&K, which established large-scale irregularities and manipulation in the recruitment process conducted in 2020.
Key Highlights of the Government Order
- The appointments of 106 candidates were found to be obtained through fraudulent means.
- Out of these, the appointments of 103 candidates have been declared illegal and void ab initio.
- The selection process involved manipulation of OMR sheets, tampering of merit lists, and illegal awarding of marks.
- The Anti-Corruption Bureau registered FIR No. 01/2025 and confirmed criminal conspiracy and result manipulation.
- The continuation of these appointees was held to be a perpetuation of illegality and against public trust.
Legal Position Clarified
The Government clarified that protection under Article 311 of the Constitution is not applicable in cases where appointments are illegal or obtained by fraud. The order relies on judgments of the Hon’ble Supreme Court and the High Court of J&K and Ladakh.
Immediate Effect of Termination
- The services of the 103 appointees stand terminated with immediate effect.
- Their names shall be removed from the establishment of the Fire & Emergency Services Department.
- The appointments are treated as null and void from the beginning.
