J&K High Court Orders Formation of Panel for Regularisation of College Faculty Appointed Before 2010
Srinagar: The High Court of Jammu & Kashmir and Ladakh has asked the Union Territory administration to set up a high-level committee to look into the regularisation of Assistant Professors (APs), Librarians, and Physical Training Instructors (PTIs) who were appointed against clear vacant posts before 2010. On Ad-hoc Contractual basis this judgement gave lot of relief to those candidates who served the Higher Education department from many years
The bench of Justices Sanjeev Kumar and Sanjay Parihar issued this direction while hearing multiple petitions filed by lecturers who have been working on temporary but continuous engagements in the Higher Education Department.
According to the court’s order, the government must form a committee within one month. The panel will be headed by the Chief Secretary and will include the Secretaries of Higher Education, General Administration, Finance, and Law Departments.
The committee has been tasked with identifying, within two months, all those candidates who:
Were appointed as APs, Librarians, or PTIs before the Jammu and Kashmir Civil Services (Special Provisions) Act, 2010 came into effect.
Were in service on the date of commencement of the Act.
Have completed at least seven years of continuous service.
The court further directed that candidates meeting these conditions should be regularised under the 2010 Act. Their regularisation will take effect retrospectively:
Those who had already completed seven years of service by the time the Act began will be regularised from the date of commencement of Act.
